Section 41 Criminal Justice and Courts Act 2015 in force 13 April 2015
Youth cautions and conditional cautions must now be given to 17 year olds in the presence of an appropriate adult, as is currently the case for children under 17 years old.
This safeguard is particularly important as children are not required to consent to receiving a caution (as is the case for adults). The remaining anomalies that result in 17 year olds being treated as adults, rather than children, at the police station are anticipated to come into force in October 2015.
