Legal terms A-Z

A court hearing that happens when a defendant has been deemed not fit to plead. 

The hearing decides whether the defendant has committed the physical act, without looking at the intention or mental state of the defendant. 

The prosecution will present the evidence but the defence cannot present an active defence. 

If the court finds that the defendant has done the act, it must give a non-penal sentence such as a Hospital Order or a Supervision Order.
